Epic Games has encouraged staff to use AI tools in development, while also pursuing a takedown against a browser-based Fortnite port, Futurism says. The contrast raises a pointed question about who gets to use AI-assisted tools to recreate games and who gets to set the rules.

Why it matters

Futurism also describes Microsoft pursuing AI-assisted reverse-engineering efforts, while its subsidiary Activision has used AI-generated artwork. These examples are part of the publication’s argument about inconsistent standards, not proof that the companies’ actions are legally equivalent. AI-assisted coding is making it easier to build things from existing games. The harder question is whether copyright rules should apply differently depending on who is doing the building.

Discuss: Should companies that use AI-generated material be held to the same copyright standards they enforce against others?
