The US Federal Trade Commission has opened an investigation into OpenAI, Anthropic and other AI companies over potential risks from their products, according to CNBC. The inquiry puts federal scrutiny of AI products on the record, but the agency has not named the other companies or detailed what it is examining.

Watch Desk analysis

What happened

An FTC spokesperson confirmed the investigation to CNBC. The report says the probe concerns potential dangers posed by AI products; it does not identify particular products, practices or alleged violations. The spokesperson declined to name any companies beyond OpenAI and Anthropic.

OpenAI and Anthropic had not immediately responded to CNBC’s requests for comment when it published its report. CNBC said the New York Post first reported the probe.

Why it matters

The investigation brings a federal agency into a debate that has often centred on companies’ own safety commitments and voluntary oversight. What the FTC is examining, and whether it names more firms or specific concerns, will determine how much this changes the argument from broad warnings to concrete scrutiny.

For now, the public account is narrow: an investigation exists, but its scope and any potential findings are not yet clear. An investigation is not a finding that a company has broken the law, and the companies’ inclusion is not proof of wrongdoing.

Our read

This is a consequential development for the AI industry, not a verdict on any company. The useful next step is to watch for the agency’s own account of the probe and for details about its scope. Until then, the headline is serious; the known facts are more limited.

What to watch

  • Whether the FTC identifies additional companies or particular products under scrutiny.
  • What the agency says the investigation covers, and whether it announces any findings or action.
  • Responses from OpenAI and Anthropic, and any further detail about the probe’s origin.

Discussion spark: Should AI product investigations begin with broad scrutiny of potential risks, or should regulators first identify specific products and conduct?

Update

What changed

The Wall Street Journal says the FTC is investigating whether Anthropic and OpenAI deceived consumers about potential harms from their AI systems. A senior FTC official told the paper that the probe was opened recently.

The official said the agency plans to send civil subpoenas to both companies in the coming weeks. That is a planned step, not confirmation that subpoenas have already been issued.

The official also told the Journal that concerns raised over the summer, including by AI researchers who warned that the technology could wipe out humanity, helped prompt the investigation. Those are attributed concerns, not findings by the FTC. An investigation is not a determination that either company deceived consumers or broke the law.
